Ministerial Order Establishing Modalities of State Assistance to a Needy Disabled Person

Ministerial Order 5 of 2009

The Minister of Local Government,Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003, as amended to date, especially in Articles 9, 10, 11, 14, 16, 120, 121 and 201;Pursuant to Law n° 01/2007 of 20/01/2007 relating to protection of disabled persons in general especially in Article 5;After consideration and approval by the Cabinet in its session of 12/09/2008;HEREBY ORDERS:

Article One – Purpose of this Order

This Order determines modalities of how the state shall assist a needy disabled person.

Article 2 – Disabled person to be assisted

Any disabled person identified by an association of the disabled in his/her locality, as a needy person having no assistance and approved by the Executive Secretary of the Cell, shall access services provided to the needy members of society.Depending on his/her category on disability, a disabled person shall access special services commensurate with requirements which facilitate him/her to help him/herself.

Article 3 – Government assistance

Basing on the provisions in Paragraph 2 of Article 2 of this Order, the Government shall channel its assistance, specially meant for needy disabled persons having no persons to cater for them, through associations of disabled persons by sending it to the District which transfers it to the Sector.Such assistance shall mainly enable the needy disabled person to access prosthesis and orthesis appliances.

Article 4 – Kind of assistance

The assistance provided for in this Order can be in terms of donating materials or enabling needy disabled persons to access them.

Article 5 – Repealing of inconsistent provisions

All prior provisions contrary to this Order are hereby repealed.

Article 6 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
