Ministerial Order granting Judicial Police Powers to the Staff of the Office of Ombudsman

Ministerial Order 67 of 2009

The Minister of Justice / Attorney GeneralPursuant to the Constitution of the Republic of Rwanda of 04 Juna2003, as amended to date, especially in Articles 120, 121 and 201;Pursuant to Law n° 25/2003 of 15/08/2003 determining the organization and functioning of the Office of Ombudsman especially in Article 17;Pursuant to Law n° 13/2004 of 17/05/2004 relating to the Code of Criminal Procedure as modified and complemented to date, especially in Article 20;Pursuant to the Presidential Order n° 27/01 of 18/07/2004 determining certain Ministerial Orders which are adopted without consideration by the Cabinet;HEREBY ORDERS:

Article One – Purpose of this Order

This Order grants Judicial Police power to specific staff of the Office of the Ombudsman.

Article 2 – Granting the competence

The staff referred to in the annex to this Order shall have the power to investigate all activities relating to the functions of the Office of the Ombudsman, to prevent and fight injustice, corruption and other related offences on the territory of the republic of Rwanda under the Law n° 25/2003 of 15/08/2003 determining the Office of the Ombudsman.

Article 3 – Execution of judicial police powers

While executing their investigation powers, the staff of the Office of the Ombudsman shall work independently and in the respect of laws.

Article 4 – Repealing of inconsistent provisions

All prior provisions contrary to this Order are hereby repealed.

Article 5 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
