Ministerial Order reserving a Part of Gishwati Forest which was Inhabited as Classified

Ministerial Order 1-MINIFOM of 2010

The Minister of Forestry and Mines,Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003, as amended to date, especially in Articles 30, 31, 32, 49, 120, 121 and 201;Pursuant to Organic Law n° 04/2005 of 08/04/2005 determining the modalities of protection, conservation and promotion of environment in Rwanda, especially in Articles 38, 40, 50, 52, 53, 61, 64, 82, 94 and 96;Pursuant to Organic Law n° 08/2005 of 14/07/2005 determining the use and management of land in Rwanda; especially in Articles 12, 14 and 15;Pursuant to Law nº 47/1988 of 05/12/1988 determining the Organisation of Forests in Rwanda, especially in Article 30;After consideration and approval by the Cabinet, in its session of 05/03/2010;HEREBY ORDERS:

Article One – Purpose of this Order

This Order shall reserve a part of Gishwati Forest as well as its boundaries which were inhabited as classified equivalent to three thousand thirty two hectares (3032 ha).

Article 2 – Reserving a part of Gishwati forest as classified

The forest area equivalent to three thousand thirty two hectares (3032 ha) previously a natural forest, located in the Western Province in Nyabihu, Rutsiro, Ngororero and Rubavu Districts, which was inhabited is hereby classified.

Article 3 – Boundaries of a part of Gishwati forest which is classified

Gishwati forest shares its boundaries with the following Districts:1)to the North by Bigogwe, Karago, and Jenda Sectors of Nyabihu District and Mudende Sector of Rubavu District;2)to the South by Kanama Sector of Rutsiro District and Gatumba Sector of Ngororero District;3)to the West by Ruhango Sector of Rutsiro District and Rubavu District;4)to the East by Mukamira Sector of Nyabihu District and Gatumba Sector of Ngororero District.The boundaries of the classified part of Gishwati forest which was inhabited are hereby annexed to this Order.

Article 4 – Restoration of Gishwati Forest

Organs in charge of forests and environment have to regenerate and restore the part of Gishwati forest specified in Article 2 of this Order from the date of the publication of this Order in the Official Gazette of the Republic of Rwanda.All citizens and administrative entities shall facilitate the Organs in charge of forest restoration.

Article 5 – Repealing provision

All prior provisions contrary to this Order are hereby repealed.

Article 6 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
