Chapter One
General provisions
Article One – Purpose of this Order
This Order determines the organization of water resources data collection, treatment, management, use and its communication.Article 2 – Definitions
For the purposes of this Ministerial Order, the following terms shall have the following meanings:1ºwater resources data: factual information related to water quality and quantity derived from measurements, analysis and observations;2ºagency: institution in charge of water resources management;Chapter II
Water resources data collection
Article 3 – Water data collection network
Water data collection, management, treatment and its use shall be conducted through a network of stakeholders composed of two (2) members from each of the following entities:1ºMinistry in charge of Natural Resources;2ºRwanda Natural Resources Authority;3ºRwanda Environment Management Authority;4ºany District that falls under the catchment area;5ºMinistry in charge of Local Governement;6ºMinistry in charge of Defence;7ºRwanda National Police;8ºMinistry in charge of Trade and Industry;9ºMinistry in charge of Agriculture and Animal Resources;10ºMinistry in charge of Infrastructure;11ºPrivate Sector;12ºacademic institutions;13ºTrans boundary river basin commissions.Article 4 – Coordination of water data collection
The Agency shall put in place a water resource data monitoring network. The Agency shall coordinate the collection of the data referred to in Article 3 of this Order through the wide network of stakeholders.Article 5 – Submission of report on collection of data on water
All water data collectors shall submit to the Agency a report on the data collected twice (2) a year.Article 6 – Follow up on data collection
The Agency shall make a follow up on the water data collection activities carried out by different stakeholders to ensure compliance with established standards.Chapter III
Treatment, management and proper use of water resources data
Article 7 – Treatment of water data
The Agency shall be required to treat water resources related data. All data collected shall be processed in order to ensure its quality before entry in the database.Article 8 – Management of water data
The Agency shall be required to process, analyse, gather and store all water resources related data in its database for decision making process.Article 9 – Proper use of water data
The Agency shall have the responsibility to properly use water resources related data and safeguard it by use of modern technology in order to facilitate durability, ease of use, transformation and sharing by the users.Chapter IV
Water resources data communication
Article 10 – Water resources data dissemination
The Agency shall be required to disseminate data on water resources through modern print or electronic communication media.Article 11 – Communication of emergency situations on water resources
The Agency shall have the responsibility to communicate any emergency situation related to water resources.Article 12 – Water resources data access fees
Any private operator, whether national or international, who requires to have access to water resources data shall be required to apply in writing and pay a fee of twenty thousand Rwandan francs (Rwf20000).Any applicant for water resources data shall be required to deposit the fee mentioned in Paragraph One of this Article on the Bank Account relating to water resources.Any applicant for water resources data who gets access to it shall use it only for the purposes related thereto and notify the Agency of the results of the usage of the water resources data.The applicant shall be required to attach the payment receipt to the request form.However, Government institutions and students undertaking research shall be permitted to have access to water resources data without any fee upon presentation of their individual requests and their identification.Chapter V
Final provisions
Article 13 – Repealing provision
All prior provisions contrary to this Order are hereby repealed.Article 14 – Commencement
This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.History of this document
