Ministerial Order determining Modalities of the Government Support to Local Non Governmental Organizations

Ministerial Order 5-MO7 of 2014

The Minister of Local Government;Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in Articles 120, 121 and 201;Pursuant to Law nº 04/2012 of 17/02/2012 determining the organization and functioning of Local Non-Government Organizations, especially in Article 12;After consideration and approval by the Cabinet, in its session of 27/11/2013;HEREBY ORDERS:

Article One – Purpose of this Order

This Order determines modalities of Government support to Local Non-Government Organizations.

Article 2 – Form of support

The Government support can be granted in the form of materials, funds or any other form related to the activity carried out by the organization within its objectives, and which is among the activities on the Government annual work plan.

Article 3 – Joint agreement

In order for the Government to grant the support stated in Article 2 of this Order, there must be a joint agreement indicating the activity to be carried out, the role of each party, the positive impact on the population and how the activity will be reported.

Article 4 – Requirements for the supported organization

Required conditions for a Local Non-Government Organization to be granted a Government support shall be as follows:to have legal personality;to submit its annual financial report in accordance with provisions of the relevant authority;to facilitate monitoring by competent authorities;to be allowed upon recommendation by the concerned District Council;to have not been temporarily suspended;having the activities to be supported under its responsibilities;to have a Representative and the deputy Representative meeting the requirements of the law governing the Local Non-Government Organizations and being persons of integrity.In this Article, the terms “a person of integrity” shall have the following meanings:not having been prosecuted;not having been dismissed for public service;not owing fiscal liabilities to the Government.

Article 5 – Local Umbrella Organizations of Non-Government Organizations

Local Non-Government Organizations that form an umbrella association granted legal personality can get the Government support as provided for by this Order.

Article 6 – Requirements for a supported umbrella organizations

For a Local Non-Government Umbrella Organization to be granted a Government support, it must meet the following requirements:All its member Organizations must meet the provisions of Article 4 of this Order;its Legal Representative and Deputy Legal Representative must meet the requirements for the Legal and Deputy Legal Representatives of a Local Non-Government Organization;It must have an organ for settling disputes as it is the case for local Non-Government Organizations.

Article 7 – Repealing provision

All prior provisions contrary to this Order are hereby repealed.

Article 8 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
