Ministerial Order on rewarding of Local Authorities that have Excelled in Forest Activities

Ministerial Order 5 of 2015

The Minister of Natural Resources;Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in Articles 120, 121 and 201;Pursuant to Law nº 47bis/2013 of 28/06/2013 determining the management and utilization of forests in Rwanda, especially in Article 22;After consideration and approval by the Cabinet, in its session of 13/02/2015;HEREBY ORDERS:

Article One – Purpose of this Order

This Order determines the award to be given to local authorities that have excelled in rational forest management activities depending on the results of their efforts and specifies the procedure to be followed in their awarding.

Article 2 – Activities for which a reward is given

Activities rewarded are the activities that carried out for sustainable forest protection and management as well as rational utilisation of forest products.Such activities shall be the following:increasing in forest resources;sustainable conservation and management of forest resources;rational utilisation of forests and their products; andany other activity that may be determined by the Authority that is in charge of forest management.

Article 3 – Local authority to be rewarded

The Sector that excelled in the forest activities in a District shall be the local authority to be rewarded.Without prejudice to Paragraph 2 of this Article, the Director General of the Authority in charge of forests may designate another entity to be awarded due to effective performance of one of the activities referred to in Article 2 of this Order.

Article 4 – Selection of the organ to be rewarded

The District authorities shall, in accordance with provisions of this Order, evaluate the activities carried out at the Sector level in terms of forest protection and management of forests and sustainable utilisation of forest products and thereafter pronounces the results on the basis of the marks obtained.The District authorities shall, within fifteen (15) days after the evaluation submit an evaluation report to the Authority in charge of forests indicating the number of Sectors to be rewarded in every District in consideration of available awards.

Article 5 – Preparation of the evaluation form

The Authority in charge of forests shall prepare an evaluation form to be used by District authorities while evaluating Sectors and provide possible technical assistance to District authorities in order to facilitate the evaluation.The form referred to in Paragraph One of this Article shall be prepared in accordance with activities to be rewarded in a given period.

Article 6 – Awards to be given

In consideration of the available budget, the following awards may be given:amount of money determined by the Authority in charge of forests;development activity in favour of an organ awarded;tools that may be used in forest pruning;a trophy;a certificate of merit;trainings in capacity building in forestry.

Article 7 – Period of awarding and ceremonies related to the granting of the award

The awards referred to in Article 6 of this Order shall be only once a year.The Authority in charge of forests shall prepare the awarding ceremonies and bear all the costs resulting from the ceremonies.

Article 8 – Repealing provision

All prior provisions contrary to this Order are hereby repealed.

Article 9 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
