Ministerial Order determining the Structure and the Contents of the List of Forests

Ministerial Order 7-MINIRENA of 2015

The Minister of Natural Resources;Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in Articles 120, 121 and 201;Pursuant to Law nº 47bis/2013 of 28/06/2013 determining the management and utilization of forests in Rwanda, especially in Article 32;After consideration and approval by the Cabinet, in its session of 13/02/2015;HEREBY ORDERS

Article One – Purpose of this Order

This Order determines the structure and the contents of the list of forests and procedures of its updating.

Article 2 – Register of forests

There is hereby established a register of forests which is used as a database containing any information relating to forests in the country.That register may be in an electronic form or in an ordinary print.The Authority in charge of forests shall design the structure of the register of forests.

Article 3 – Structure and content of the list of forests

The list of forests shall be recorded in the appropriate register and specify the following:the name of the owner of the forest;the name of the forest, if applicablethe forest code;the Village, Cell, Sector and District in which the forest is located;planting period of the forest;dominant tree species in the forest;expected use of forest;status of the forest;surface area of the forest;10°limits of the forest, if possible;11°Global Position System (GPS) coordinates of the forest;12°altitude of the forest.The content of the list of forests referred to in Paragraph One of this Article shall be recorded in accordance with the order in that Paragraph.

Article 4 – Registration of forests

Any owner of the forest, whether an individual or the State, must register his/her forest in the appropriate register on the basis of its categories.

Article 5 – Filling, keeping and updating the register of forests

The register of forests must be filled in a period not exceeding three (3) months from the time this order comes into force.The Authority in charge of forests must safely keep the register of forests and update every five (5) years and whenever necessary.

Article 6 – Repealing provision

All prior provisions contrary to this Order are hereby repealed.

Article 7 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
