Prime Minister's Order determining the Functioning of the Steering Committee in charge of Approval and Oversight of Public Private Partnerships

Ministerial Order 75 of 2017

The Prime Minister;Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 119, 120, 122, and 176;Pursuant to Law n° 14/2016 of 02/05/2016 governing public private partnerships, especially in Article 7;On Proposal by the Chief Executive Officer of Rwanda Development Board and Cabinet Member;After consideration and approval by Cabinet meeting, in its session of 03/02/2017;HEREBY ORDER:

Article One – Purpose of this Order

This Order determines the functioning of the Steering Committee in charge of approval and oversight of public private partnership, hereinafter referred to as Steering Committee.

Article 2 – Convening the Steering Committee meetings

The meeting of the Steering Committee is convened any time it is considered necessary upon invitation by the Minister in charge of finance and economic planning or, in his/her absence, by the Chief Executive Officer of Rwanda Development Board.

Article 3 – Notification of Steering Committee meeting

Any meeting of the Steering Committee is convened through a written notification at least seven (7) days before the date of the meeting, except if all members of the Steering Committee accept for a short notice through electronic mail. The notification must state the time, date, location, agenda of the meeting and be accompanied by all the relevant documents to be discussed at the meeting.

Article 4 – Quorum for the meetings of the Steering Committee

The quorum for the meetings of the Steering Committee is at least two thirds (2/3) of its members. When such a number is not reached, the meeting is deferred to another date agreed upon by members present. If the meeting is convened for the second time due to lack of quorum, it is held if at least two (2) of its members are present.Members of the Steering Committee shall not be represented in the meetings. However, members of the Steering Committee who are unable to attend a meeting may provide their opinions by electronic communication or any other means approved by the Steering Committee.

Article 5 – Invitation of resource person in meetings of the Steering Committee

The Steering Committee may invite in its meetings any person from whom it may seek advice on a certain item on the agenda. That person is chosen on the basis of his/her specific skills but is not allowed to vote.

Article 6 – Secretariat of the Steering Committee

Rwanda Development Board serves as the secretariat of the Steering Committee.

Article 7 – Adoption of the resolutions of the Steering Committee

The decisions of the Steering Committee are taken by consensus of the members present.Steering Committee resolutions are signed by its members present immediately at the end of the meeting. The original copy of the report of the Steering Committee meeting is kept by Rwanda Development Board and a copy thereof is transmitted to other members of the Steering Committee.

Article 8 – Authorities responsible for the implementation of this Order

The Minister of Finance and Economic Planning, the Minister of Infrastructure and the Chief Executive Officer of Rwanda Development Board are entrusted with the implementation of this Order.

Article 9 – Repealing provision

All prior provisions contrary to this Order are repealed.

Article 10 – Commencement

This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
