Ministerial Order determining Modalities for Special Treatment of Persons with Disabilities in Schools

Ministerial Order 7 of 2016

The Minister of Education;Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 121, 122 and 176;Pursuant to Organic Law n° 02/2011/OL of 27/07/2011 governing organization of education, especially in Article 10;Pursuant to Law n° 01/2007 of 20/01/2007 relating to protection of disabled person in general, especially in Articles 11 and 13;After consideration and approval by the Cabinet, in its session of 14/10/2015;HEREBY ORDERS:

Article One – Purpose of this Order

This Order determines modalities for special treatment of persons with disabilities in schools.

Article 2 – Supporting pupils or students with disabilities to study

The State shall support pupils or students with disabilities from needy families who study in specialized or ordinary schools from nursery, primary and secondary levels by providing them with school requirements.If pupils or students with disabilities attend public or Government subsidized higher learning institutions:they shall receive bursaries or study loans whenever they meet the requirements;the State shall assist them to get accommodation at school.

Article 3 – Source of funds to pay for pupils or students with disabilities

The Ministry in charge of education shall allocate funds in every annual budget to pay for pupils or students with disabilities in schools.However, for students in higher learning institutions, the public agency in charge of bursary and loans shall be responsible for provision of the required funds.

Article 4 – Responsibilities of teachers

If there are pupils or students with disabilities in ordinary schools, teachers in those schools shall have the obligation to provide special care to them and sensitize other pupils or students to respect their rights and to assist them where necessary.The teachers must also provide specific didactic materials in case pupils or students with disabilities are unable to use material designed for others. The Headmaster shall facilitate the teachers in acquisition of the didactic materials.If there is a pupil or a student with disabilities who is unable to sit for the same exams or under the same conditions with fellow pupils or students, the respective teacher shall prepare special exams for the pupil or student with disability and in special conditions.

Article 5 – Responsibilities of teacher training institutions

Teacher training institutions shall have the responsibility of teaching how to assist pupils or students with disabilities to study without any obstacles.

Article 6 – Responsibilities of other organs in charge of education

Districts, public organs in charge of curricula, an organ in charge of higher education and the Ministry in charge of education shall facilitate teachers in schools with pupils or students with disabilities:to acquire the needed materials;to upgrade their skills in helping pupils or students with disabilities in a special way through continuous trainings.

Article 7 – Construction of new schools

The new public schools, Government subsidized or private schools infrastructures must be built in a way that facilitates persons with disabilities to access all venues in the infrastructures.

Article 8 – Repealing provision

All prior provisions contrary to this Order are hereby repealed.

Article 9 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
