Ministerial Order determining the Officer of the Health Facility with Powers of Civil Registrar

Ministerial Order 1 of 2020

The Minister of Local Government,Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 121, 122 and 176;Pursuant to Law nº 32/2016 of 28/08/2016 governing persons and family as amended to date, especially in Article 65;After consideration and approval by the Cabinet, in its meeting of 16/06/2020;ORDERS:

Article One – Purpose of this Order

This Order determines the officer of the health facility with powers of civil registrar, his or her responsibilities and modalities for their performance.

Article 2 – Officer of the health facility with powers of civil registrar

Within a health facility, the officer vested with the powers of civil registrar is determined as follows:the Director of the Unit of nurses and midwives, in a referral hospital;the Director of the Unit of nurses and midwives, in a provincial hospital;the Director of the Unit of nurses and midwives, in a District hospital;the Head of a health centre;the Head of a private health facility or the officer with delegation.The civil registrar at a health facility must not have been sentenced to a term of imprisonment of six (6) months or more.

Article 3 – Responsibilities of the civil registrar at a health facility

The civil registrar at a health facility has the following responsibilities:to receive declarations of births occurred in the health facility;to draw up civil status records in relation to births, correcting them and issuing their copies;to receive declarations of deaths occurred in the health facility;to draw up civil status records in relation to death, correcting them and issuing their copies thereof;keeping and preserving civil status registers.

Article 4 – Requirements for a civil registrar of a private health facility

When a head of a private health facility does not have the Rwandan nationality, he or she nominates an officer of Rwandan nationality to be vested with the powers of the civil registrar upon approval by the District authorities where that facility is located.The civil registrar at a private health facility must firstly take oath for those responsibilities before the superior of the civil registrar of the jurisdiction where that facility is located.

Article 5 – Performance of responsibilities of civil registrar

The civil registrar at a health facility discharge his or her responsibilities in accordance with relevant laws.

Article 6 – Record issued to a person declaring a birth occurred in a health facility

A person who declares a birth occurred in a health facility receives a copy of the child birth record which indicates a specific identification number to the registered born child. That number identifies him or her during the whole life.

Article 7 – Declaration of a death occurred in a health facility of unknown person

When the civil status of a person deceased in the health facility is not known, the agent of health facility in charge of social affairs declares the death.

Article 8 – Supervision of the activities of a civil registrar at a health facility

In his or her responsibilities related to civil registration, the civil registrar at a health facility is supervised by the civil registrar at the level of the Sector where the health facility is located.

Article 9 – Repealing provision

All prior provisions contrary to this Order are repealed.

Article 10 – Commencement

This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
