Article One – Purpose of this Order
This Order determines the structure and content of the aquaculture and fishing concession contract.Article 2 – Parties to the contract
The aquaculture and fishing concession contract shall indicate the contracting parties.Article 3 – Responsibilities of conceding authority
The aquaculture and fishing concession contract shall provide the responsibilities of the conceding authority including:1°to show diligence in the granting of any administrative document required for exploitation of the concession;2°to follow up the emplimentation of concession contract;3°to participate actively in conflicts settlement arising from implementation of concession contract;4°to control whether aquaculture and fishing activities conducted in the concession comply with regulations regarding the use and management of water resources.Article 4 – Responsibilities of the concession holder
The aquaculture and fishing concession contract shall provide the responsibilities of the concession holder including:1°to use the concession in respect of the terms and conditions of the concession contract;2°to respect the provisions of the Law regulating the use, conservation, protection and management of water resources;3°to keep detailed statistical data on the captures;4°to make a monthly report in which the aforementioned statistical data mentioned in point 3° of this Article and any useful information shall be included and summit it to Minister in charge of water resources.Article 5 – Duration of the concession contract
The aquaculture and fishing concession contract shall provide its duration which may be extended, but shall not exceed thirty (30) years.Article 6 – Amendment or cancellation of the contract
The aquaculture and fishing concession contract shall indicate the reasons for its amendment and cancellation.Article 7 – Structure of the concession contract
The standard aquaculture and fishing concession contract is annexed to this Order.Article 8 – Repealing provision
The Ministerial Order n° 006/11.30 of the 18/11/2010 determining the form and content of the aquaculture and fishing concession contract, and all prior provisions contrary to this order are hereby repealed.Article 9 – Commencement
This Order shall come into force on the day of its publication in the Official Gazette of the Republic of Rwanda.History of this document
