Prime Minister's Order determining the Organisation, Functioning and Composition of the National Water Consultative Commission

Prime Ministers Order 143 of 2013

The Prime Minister;Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in Articles 118, 119, 120, 121 and 201;Pursuant to Law nº 62/2008 of 10/09/2008 putting in place the use, conservation, protection and management of water resources regulations, especially in Article 16;On proposal by the Minister of Natural Resources;After consideration and approval by the Cabinet, in its session of 14/11/2012;HEREBY ORDERS:

Chapter One
General provisions

Article One – Purpose of this Order

This Order determines the organisation, functioning and composition of the National Water Consultative Commission.

Chapter II
Organisation of the Consultative Commission

Article 2 – Consultative Commission

The National Water Consultative Commission shall be a consultative organ without legal personality and financial and administrative autonomy.The national Consultative Commission may provide its recommendations on issues submitted to it and the recommendations may be implemented.The Ministry in charge of water resources shall make a follow up on the implementation of the recommendations given by the Consultative Commission.

Article 3 – Composition of the National Consultative Commission

The National Water Consultative Commission shall be composed of:the Minister in charge of water resources;the Minister in charge of water supply and Energy;the Minister in charge of agriculture and animal resources;the Minister in charge of administration and local government;the Minister in charge of natural disasters management;the Minister of Defense;the Director General of the Authority in charge of water resources management;the Director General of the Rwanda Bureau of Standards;the Director General of the Agency in charge of water supply and energy;10°the Director General of the Authority in charge of environment;11°the Chief Executive Officer of Rwanda Development Board;12°the Director General of Rwanda Agricultural Board;13°the Representative of the Private Sector;14°the representative of Universities offering courses related to water;15°representative of non-governmental organisations working in water sector.

Article 4 – Management of the Consultative Commission

The Consultative Commission shall be headed by the Minister in charge of water resources. In case of his/her absence, he/she shall be deputised by the Minister in charge of water supply.The Director General of the agency in charge of water resources management shall act as the Secretary of the Consultative Commission.

Article 5 – Supervising Authority

The Office of the Prime Minister shall be the supervising Authority of the National Consultative Commission at the national level.

Chapter III
Functioning of the National Consultative Commission

Article 6 – Meetings of the Consultative Commission

The Consultative Commission shall meet once in six (6) months and whenever it is considered necessary.The meeting of the Consultative Commission shall be convened and chaired by its Chairperson or the Vice chairperson in case of absence of the Chairperson. The invitation must reach the members at least fifteen (15) days before the meeting is held.

Article 7 – Meeting sessions and decision taking

The meeting shall be held if at least two thirds (2/3) of the members of the Consultative Commission are present and it shall take decisions on the absolute majority vote of the members present.

Article 8 – Reports of the meetings

The Chairperson and the Secretary of the Consultative Commission shall sign the report containing the recommendations of the Consultative Commission in a period not exceeding five (5) days from the date the meeting is held.The Chairperson shall submit the report of the Consultative Commission to the Prime Minister with copies to the organs in charge of the implementation of the recommendations.

Article 9 – Logistical requirements of the Consultative Commission

The Ministry in charge of water resources shall provide the National Water Consultative Commission with the necessary logistical requirements to enable it to effectively fulfil its responsibilities.

Chapter IV
Final provisions

Article 10 – Authority responsible for the implementation of this Order

The Minister of Natural Resources is entrusted with the implementation of this Order.

Article 11 – Repealing provision

All prior provisions contrary to this Order are hereby repealed.

Article 12 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
