Article One – Purpose of this Order
This Order determines the members of the Advisory Council on the use of agrochemicals, hereinafter referred to as “Advisory Council”, and their responsibilities.Article 2 – Members of the Advisory Council
The Advisory Council shall be comprised of ten (10) permanent members from the following six (6) fields:1°three (3) researchers including:a.specialist in pathology and entomology;b.specialist in soil fertility;c.specialist in agricultural popularization, specifically in school of agriculture;2°one (1) specialist environmentalist in agrochemical impact assessment3°one (1) specialist in standardization of agrochemicals;4°one (1) lawyer specialist in agriculture and livestock;5°two (2) representatives of agrochemical dealers;6°two (2) representatives of farmers’ organizations.The Cabinet may, upon proposal of the Minister responsible for agriculture, appoint two (2) additional members of the Advisory Council, when it considers that they have knowledge and experience to contribute in the fulfillment of the Council’s responsibilities.The additional members appointed to the Advisory Council as provided for by Paragraph 2 of this Article shall attend its meetings but they do not have the right to vote during decision making.Article 3 – Term of office of the Advisory Council
The term of office of the members of the Advisory Council shall be five (5) years renewable only once.Article 4 – Responsibilities of the Advisory Council
The Advisory council shall have the following responsibilities:1°to perform all necessary assignments to direct and advise the Registrar of agrochemicals in determining or controlling instructions regulating the manufacturing, importation, distribution, use, sale and disposal of agrochemicals in accordance with the Law;2°to make a follow up on the compliance with the provisions of the Law and to advise the Registrar of agrochemicals, on issues of granting business license of agrochemicals;3°to collaborate with the manufacturers of agrochemicals and their representatives in drafting and publication of the code of conduct with regard to regulation of agrochemicals.Article 5 – Bureau of the Advisory Council and term of office of its members
The Bureau of the Advisory Council shall be composed of a President, a Vice President and a Secretary elected by their peers during the first meeting that is convened and chaired by the Minister responsible for Agriculture.The term of office of the members of the Bureau of the Advisory Council shall be three (3) years which may be renewable only once.Article 6 – Meetings of the Advisory Council
The Advisory Council shall meet at least thrice a year, in time and place determined by its President or in his/her absence, the vice-President.In case of absence of both of the President and the Vice President of the Advisory Council, its members present in the meeting shall elect among themselves the chairperson of the meeting.Article 7 – Advisory Council’s decisions
The decisions of the Advisory Council shall be taken upon the absolute majority of the members present in a meeting. In case of a tie, the Chairperson’s vote shall be decisive.Article 8 – Committees of the Advisory Council
The Advisory Council shall establish among itself a committee responsible for approval of agrochemicals and any other necessary committees to deal with particular technical issues.Article 9 – Sitting allowances of members
Sitting allowances granted to the members of the Council shall be determined in accordance with relevant laws.Article 10 – Secretariat of the Advisory Council
The Registrar of agrochemicals shall also be the Secretary of the Advisory Council. He/she shall attend its meetings and provides his or her opinions but does not vote during decision making.Article 11 – Internal rules and regulations of the Advisory Council
The Advisory Council shall establish its internal rules and regulations.Article 12 – Authorities responsible for the implementation of this Order
The Minister of Agriculture and Animal Resources and the Minister of Public Service and Labor is entrusted with the implementation of this Order.Article 13 – Repealing provision
All prior provisions contrary to this Order are hereby by repealed.Article 14 – Commencement
This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.History of this document
