Prime Minister's Order determining the Amount of Funeral Expenses for a Deceased Public Servant

Prime Ministers Order 124 of 2015

The Prime Minister;Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in Articles 118, 120, 121 and 201;Pursuant to Law n° 86/2013 of 11/09/2013 establishing the General Statutes for Public Service, especially in Article 104;Reviewing Prime Minister's Order n° 06/03 of 15/03/2003 determining amount of funeral indemnities;After consideration and approval by the Cabinet, in its session of 20/03/2015;HEREBY ORDERS:

Article One – Purpose of this Order

This Order determines the amount of funeral expenses for a deceased public servant.

Article 2 – Amount of funeral indemnity

If a public servant dies, his/her employing institution shall pay to his/her family a funeral indemnity equal to seven hundred thousand Rwandan francs (Rwf 700,000) net.When the death of a public servant is caused by work accident or disease caused by work, the employer shall allocate funeral indemnity to the family of the deceased employee specified in Paragraph One of this Article without prejudice to additional payment by Rwanda Social Security Board of the deceased insurance allowances in accordance with relevant laws.

Article 3 – Beneficiaries of funeral indemnity

Funeral indemnity shall be paid to the legally recognized spouse of the deceased employee or their legal successors. In case there are no legal successors, competent authorities at Sector level shall decide on the allocation of such funeral indemnity to any other person.Funeral indemnity shall be paid after beneficiaries referred to in Paragraph One of this Article have provided a death certificate issued by a medical doctor recognized by Government or the Executive Secretary of Sector where death occurred.

Article 4 – Period of payment

The payment of funeral indemnity shall be paid before the funeral ceremonies.

Article 5 – Transport facilitation for supporting a workmate

In case of death of a spouse or a first degree parent, son, brother or sister of a public servant, the employing institution shall provide reasonable and justifiable transport faciliation to his/her workmates who have been authorized to support him/her.Transport facilitation shall also apply for public servants who shall go to support the family of the deceased, in case of death of a public servant belonging to their employing institution.

Article 6 – Authorities responsible for the implementation of this Order

The Minister of Public Service and Labour and the Minister of Finance and Economic Planning are entrusted with the implementation of this Order.

Article 7 – Repealing provision

Prime Minister's Order n° 06/03 of 15/03/2003 determining amount of funeral indemnities and all other prior provisions contrary to this Order are hereby repealed.

Article 8 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
