Prime Minister's Order determining the Amount and Payment Modalities of Contributions from all Health Insurance Entities Operating in Rwanda

Prime Ministers Order 198 of 2015

The Prime Minister,Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003, as amended to date, especially in Articles 118, 119, 121 and 201;Pursuant to Law n° 03/2015 of 02/03/2015 governing the organisation of the community-based health insurance scheme, especially in Article 15;On proposal by the Minister of Finances and Economic planning;After consideration and approval by the Cabinet, in its session of 05/08/2015;HEREBY ORDERS:

Article One – Purpose of this Order

This Order shall determine the amount and payment modalities of contributions from all health insurance entities operating in Rwanda.

Article 2 – Amount of contributions

Contribution from each health insurance entity operating in Rwanda shall be five percent (5%) of all annual contributions collected under the health insurance branch of the health insurance entity.

Article 3 – Modalities and timeline for payment

Contribution from each health insurance entity shall be paid to the public institution in charge of community-based health insurance within thirty (30) days counted from the date of the end of the financial year of the health insurance entity.In the event the health insurance entity fails to pay its contributions within the period provided for by this Order, it shall pay interest for late payment on the amount of due contributions.The interest rate shall be fixed at 1% and calculated on a monthly basis, non-compounded, counting from the first date following the due payment date of the contribution to the date of payment.Any incomplete month shall be considered as an entire month for the purpose of calculating interest for late payment.

Article 4 – Audit

When the public institution in charge of the community-based health insurances identifies a miscalculation, an omission, a misrepresentation, an understatement or any other error in the contributions paid, it shall have the right to conduct an audit based on established standards.

Article 5 – Penalty for understatement of contributions

If following an audit, the amount on paid contributions is less than the amount to be paid by the health insurance entity, the health insurance entity shall pay the unpaid contributions and be sanctioned by an administrative penalty of two hundred percent (200%) of the unpaid contributions.

Article 6 – Informal appeal

A health insurance entity which is not satisfied with the findings of the audit may lodge an informal appeal in writing to the appeal organ of the public institution in charge of the community-based health insurance within thirty (30) days after receipt of the audit report.The appeal organ shall make a decision within a period of sixty (60) days and communicate it to the appellant. If a decision is not taken within this period, the appeal shall be deemed to have a basis.

Article 7 – Judicial appeal

A health insurance entity that is not satisfied with the decision of the appeal organ may lodge a judicial appeal to the competent court. The appeal shall be lodged within thirty (30) days following the receipt of the decision.

Article 8 – Effect of appeal

No appeal shall suspend the obligation to pay contributions and interests.

Article 9 – Authorities responsible for the implementation of this Order

The Minister of Finance and Economic Planning and the Minister of Health are entrusted with the implementation of this Order.

Article 10 – Repealing provision

All prior provisions contrary to this Order are hereby repealed.

Article 11 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
