Prime Minister's Order determining another Regulatory Authority for Trade of Petroleum and Petroleum Products and its Additional Responsibilities

Prime Ministers Order 131 of 2016

The Prime Minster;Pursuant to the Constitution of the Republic of Rwanda of 2003 amended in 2015, especially in Articles 119, 120, 121 and 176;Pursuant to Law n° 85/2013 of 11/09/2013 regulating petroleum and petroleum products trade in Rwanda, especially in Articles 4 and 5;After consideration and approval by the Cabinet, in its session of 29/03/2016;HEREBY ORDERS:

Article One – Purpose of this Order

This Order determines another regulatory authority for trade of petroleum and petroleum products and its additional responsibilities.

Article 2 – Another regulatory authority for trade of petroleum and petroleum products

The Rwanda Utility Regulatory Authority (RURA) is vested with the mission to regulate all operations, activities, installations, equipment and other facilities directly or indirectly in relation to trade of petroleum and petroleum products.

Article 3 – Additional responsibilities for the regulatory authority for trade of petroleum and petroleum products

Subject to provisions of Article 5 of the Law n° 85/2013 of 11/09/2013 regulating petroleum and petroleum products trade in Rwanda, the additional responsibilities in regard to trade of petroleum and petroleum products are the following:to monitor and regulate petroleum infrastructure installations and related activities;to participate in the elaboration of the national trade policy of petroleum and petroleum products;to control the quality of petroleum and petroleum products in accordance with applicable standards;to initiate and conduct investigations in relation to safety and quality of services provided to consumers;to put in place all necessary regulations to operationalize the Law regulating petroleum and petroleum products trade in Rwanda;to ensure sustainable commercialization of petroleum and petroleum products at a competitive price;to set up an effective price monitoring mechanism of petroleum and petroleum products.

Article 4 – Modalities of implementation of responsibilities for regulating trade of petroleum and petroleum products

Responsibilities for regulating trade of petroleum and petroleum products are implemented in accordance with relevant laws.

Article 5 – Authority entrusted with the implementation of this Order

The Minister of Trade and Industry is entrusted with the implementation of this Order.

Article 6 – Repealing provision

All prior provisions contrary to this Order are hereby repealed.

Article 7 – Commencement

This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
