Presidential Order determining the Sharing out of Funds Deposited into the Joint Account of City of Kigali and its Districts

Presidential Order 2 of 2015

We, KAGAME Paul,President of the Republic;Pursuant to the Constitution of the Republic of Rwanda of 04 June 2013 as amended to date, especially in Articles 112, 113, 121 and 201;Pursuant to Law nº 87/2013 of 11/09/2013 determining the organisation and functioning of decentralised administrative entities, especially in Article 120;Upon request from the Minister of Local Government;After consideration and approval by the Cabinet Meeting in its session of 15/10/2014;HAVE ORDERED AND HEREBY ORDER:

Article One – Purpose of this Order

This Order determines the sharing of the funds deposited into the joint account between the City of Kigali and each District of the City of Kigali. It also determines the modalities for this sharing as well as the major activities specific to the City of Kigali.

Article 2 – Sharing of funds

The sharing of the funds deposited into the joint account between the City of Kigali and each District of the City of Kigali is done as follows:1°the City of Kigali gets 30% of the funds deposited into the account;2°The District in the City of Kigali gets 70% of the funds deposited into the account.The sharing is carried out every month and any time deemed necessary.

Article 3 – Funds not deposited into the joint account

The funds which shall not be paid into the joint account are the following:1°loans taken out by the District or the City of Kigali in accordance with the Law;2°revenues of the City of Kigali;3°interests on bank placement;4°donations and bequests;5°accounts balance for the previous year;6°income from the District or the City of Kigali's own assets.

Article 4 – Development activities specific to the City of Kigali

The development activities specific to the City of Kigali include in particular the following activities:1°the implementation of the City of Kigali Master Plan;2°the development activities extending beyond One District of the City of Kigali;3°major activities implemented in One District of the City of Kigali but important for the population residing in other Districts of the City of Kigali;4°new activities requiring means and expertise beyond the District's capacities;5°activities initiated from national level or from a partner and determined as such within the framework of partnership.

Article 5 – Role of the District and of the City of Kigali in activities jointly implemented

The Executive Committee of the City of Kigali and District Executive Committees decide the development activities to be jointly implemented by Districts and the City of Kigali in order to incorporate them into the budget by indicating each party's financial contribution.

Article 6 – Authorities responsible for the implementation of this Order

The Minister of Local Government and the Minister of Finance and economic Planning are entrusted with the implementation of this Order.

Article 8 – Repealing provision

All prior provisions contrary to this Order are hereby repealed.[Please note: numbering as in original.]

Article 9 – Commencement

This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
