Presidential Order determining Official Public Holidays

Presidential Order 54 of 2017

We, KAGAME Paul,President of the Republic;Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 112, 120, 122 and 176;Pursuant to Law n° 86/2013 of 11/09/2013 establishing the general statutes for public service, especially in Article 30;Pursuant to Law n° 13/2009 of 27/05/2009 regulating labour in Rwanda, especially in Article 59;Having reviewed Presidential Order n° 42/03 of 30/06/2015 determining official holidays;On proposal by the Minister of Public Service and Labour;After consideration and approval by the Cabinet, in its session of 27/04/2016;HAVE ORDERED AND HEREBY ORDER:

Article One – Purpose of this Order

This Order determines official public holidays.

Article 2 – Scope of application

This Order applies to all employees and employers in the public and private sector.

Article 3 – Official public holidays

Official public holidays in the public and private sector are as follows:01 January: New Year’s day;02 January: Day after New Year’s Day;01 February: National Heroes’ Day;Good Friday;Easter Monday;07 April: Genocide perpetrated against the Tutsi Memorial Day;01 May: Labour Day;01 July: Independence Day;04 July: Liberation Day;10°Friday of the first week of August: Umuganura Day;11°15 August: Assumption Day;12°25 December: Christmas Day;13°26 December: Boxing Day;14°EID EL FITR: the date is announced each year by Rwanda Moslems’ Association;15°EID AL-ADHA: the date is announced each year by Rwanda Moslems’ Association.

Article 4 – Coincidence of official public holidays with weekend days

Except 07 April, Genocide perpetrated against the Tutsi Memorial Day, if an official public holiday falls on weekend, the following working day becomes an official public holiday.If two (2) consecutive official public holidays fall on weekend, the two (2) official public holidays are compensated in one (1) working day that follows.In case of coincidence of two (2) official public holidays, the following working day becomes an official public holiday to compensate one (1) of the two (2) coinciding public holidays.

Article 5 – Authorities responsible for the implementation of this Order

The Prime Minister and the Minister of Public Service and Labour are entrusted with the implementation of this Order.

Article 6 – Repealing provision

Presidential Order n° 42/03 of 30/06/2015 determining official holidays and all prior provisions contrary to this Order are repealed.

Article 7 – Commencement

This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
